Ltd., a Singapore company (“Creative”). The Products listed for sale on the Website are owned by Dealtech Gadgets and Services Private Limited., an India-based company incorporated under the Indian Companies Act of 2013 (“DGSPL”, “we”, or “us”) and DGSPL has been authorised by Creative to sell Products via this Website.

1. DGSPL reserves the right to update or modify these Terms and Conditions at any time without prior notice. Your use of this Website following any such change constitutes your agreement to follow and be bound by the Terms and Conditions as and when they are modified by electronically accepting this Agreement, you confirm your acceptance and it would be accepted as would a written agreement with your signature.
2. These Terms and Conditions (“Agreement”) are between DGSPL (which expression shall unless repugnant to or inconsistent with the context, mean and include the successors and permitted assigns) of the One Part and you, the user of the Website as a website visitor or as a person intending to make a purchase or actually making a purchase through this Website.
3. In no event shall DGSPL or Creative be liable for any damages whatsoever arising out of, or in connection with, your access of this Website or any information contained at the Website or any linked websites. In particular, DGSPL and Creative shall not be liable for special, indirect, consequential or incidental damages, whether an action alleging such damages is brought in contract, negligence or tort. DGSPL and Creative will not be responsible for any liability arising out of the conduct of its employees, associates, contractors and suppliers that may cause any financial or other loss to you.
4. The ownership and proprietary rights in the Website and its contents are owned by Creative. Purchases of Products on this Website do not transfer any of the intellectual property related to the Products, their design or concepts to you.
5. This Website may contain hyperlinks to websites operated by parties other than DGSPL and/or Creative. Such hyperlinks are provided for your reference only. Neither DGSPL nor Creative control such websites and is not responsible for their content. The inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators by DGSPL and/or Creative.
6. In no event shall DGSPL or Creative be liable for any damages whatsoever arising out of, or in connection with, your access of this Website or any information contained at the Website or any linked websites.
7. DGSPL may at any time make changes to the policies and terms and conditions including the privacy policy, and shipping policy without any prior notice and it may do so with no prior permissions from users of the site or service.
8. Upon purchase of the Product, you will be entitled to the warranty as provided with the Product. Creative will not be responsible or liable to comply with any warranties over and above or in addition to the warranties provided with the Product and/or under applicable laws.
9. You will be required to pay for the products ordered through the Website upfront through a Credit card, Debit Card, Internet banking, Wallet or EMI Option available on the website on delivery of the Products(if available). Any order placed with DGSPL, cannot be cancelled once it has been processed. Sales of Products via this Website are made between DGSPL and users of this Website.  You agree that Creative will not be a party to any such sales of Products via this Website between you and DGSPL, nor will Creative be liable to you for any act or omission of DGSPL and/or claims for damages, lost profits and/or lost revenue, arising from or otherwise relating to the supply of Products to you, even if Creative has been advised of such issues.
10. DGSPL has the right to assign or transfer all or part of its rights or obligations under this Agreement without prior notification.
11. This Agreement shall be subject to and construed in accordance with the laws of India and the Parties hereby submit to the exclusive jurisdiction of the courts of Ahmedabad.
12. In the event of any disputes, differences or controversies between the Parties hereto, out of or in connection with the provisions of this Agreement, or any action is taken hereunder, the Parties hereto shall thoroughly explore all possibilities for an amicable settlement. In case an amicable settlement cannot be reached, such disputes, differences or controversies shall be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 including any amendment or re-enactment thereof. The proceedings of such arbitration shall be conducted in English language and the venue of such arbitration shall be Ahmedabad. The award of such arbitration shall be final and binding upon the Parties hereto.
13. All notices, demands or other communications required or permitted to be given or made under or in connection with this Agreement shall be in writing and shall be sufficiently given or made (i) if delivered by hand, or (ii) sent by pre-paid registered post, addressed to DealTech Gadgets And Services Private Limited, at the following office address:

    PRODUCT PRICING
14. Product prices listed on the website are current. While every care has been taken to label the Products accurately, errors in data entry and updation may occur. We reserve the right to cancel the order in case a transaction has been made where the price indicated was not the correct price. In the rare event that this happens, we will give a full refund of all money received from the customer.
15. Prices are subject to change without advance notice.
16. All prices on this web site in Indian Rupees.
17. All orders are acknowledged at current pricing. We will bill at the price in effect at the time of receipt of money and raising of an invoice.
18. The Products sold via this Website are liable for GST in India. GST is included in the price mentioned on the website. A breakdown of all taxes will be provided in the Invoice.
    
    CANCELLATIONS; PRODUCT RMA
19. Once the order has been placed and the funds have been received by us. The order is considered to be in the processing stage. The following policy will apply to cancellation requests at various stages of the transaction:
    Order once placed can be cancelled only up to 24 hours after placing the order, no cancellation will be accepted after 24 hours
    In cases where the goods have been shipped from the warehouse and a cancellation request is generated. Then the order will not be cancelled.
20. Our Endeavour is to ensure that Products are available with us at all times. However, in cases where the Products are not available and not likely to be available for a reasonable period of time, a full refund will be given to the customer after informing the customer via email and phone. No charges will be levied on the customer. Refunds will be processed, within 72 hours of receiving the request in writing from the customer who has placed the order.  If the order is placed through a credit card then the funds will be transferred through the payment gateway to the same credit card. Once the transfer is initiated the customer will be given a bank reference ID for the refund process. The transfer of funds is done through third-party gateways and will take between 7-10 working days to reflect in the customer’s account.
21. This policy is in force since 1^st January 2023. Any change in the policy will be at the sole discretion of DGSPL. By Accepting this policy you are accepting the terms conditions, charges as mentioned in the policy.
22. If you have bought a Creative Product from www.india-creative.com, you may approach our local agent, Inspirisys Solutions Limited, with the official receipt for such purchase, for applicable RMA support or technical services.
